Two Executives Sentenced for Multi-Million Dollar Forex Trading Fraud Scheme

A federal jury in Colorado has sentenced Michael Shawn Stewart to 24 years in prison for his role in a large-scale foreign exchange (forex) trading fraud. Stewart was convicted on multiple counts of wire fraud and conspiracy, related to a scheme that deceived investors with false claims about an algorithmic trading program. The fraudulent activity occurred between 2015 and 2019, during which Stewart and his co-defendant Bryant Edwin Sewall operated offshore firms Mediatrix Capital and Blue Isle Markets. These companies provided investors with misleading information, falsely stating they had never experienced a losing month in their trading performance.

Court documents revealed that the defendants supplied fabricated account statements showing only positive trades while concealing significant losses. Investors were charged a total of $45 million in markups, and Stewart and Sewall collected approximately $28 million in performance fees. Despite promising returns exceeding $179 million, the companies held just under $10 million when the scheme unraveled.

Stewart’s sentence includes 288 months of federal imprisonment and an order to pay $93.3 million in restitution. Sewall had previously received a 23-year prison sentence for the same offenses. The U.S. Securities and Exchange Commission (SEC) intervened in 2019 with an emergency asset freeze against the firms and involved individuals, including Stewart and Sewall. This receivership remains active as legal proceedings continue.

In a related regulatory development, BNP Paribas has been released from a Federal Reserve consent order that dated back to 2017 concerning its forex trading operations. The enforcement action originally involved penalties exceeding $246 million. This marks an end to one of the significant regulatory measures addressing forex market practices by a major banking institution.

These cases highlight increasing scrutiny and enforcement actions targeting fraudulent activities and compliance failures within the forex trading industry. Regulatory bodies continue to prioritize investor protection by pursuing legal action against those who mislead clients or violate market rules.
